Cost-saving packaging licensing

Together with Grüner Punkt, we would like to put more focus on packaging recycling and sustainability in online retail. As an online retailer, you must participate in a collection, recovery and recycling system. Here it is important to keep an overview and clarify important questions and terms regarding the obligations.
Manufacturer
If you are the manufacturer of the goods you sell, all packaging with which the articles are packed and then sent to private end consumers must be registered with the collection, recovery and recycling system of a dual system.
If you do not comply with this obligation, you may be subject to severe fines.
Procurement from Germany
If you purchase goods from domestic producers or traders that are already packaged, this packaging does not have to be included.
Only if you add packaging or packaging components and then send them to your customers are you obliged to include them in a collection, recovery and recycling system.
Procurement from abroad
If you import already packaged goods from abroad, you are obliged to participate these packagings in a collection, recovery and recycling system, provided that you are strong legally responsible for these goods when crossing the border.
Here, again, any packaging components that you still add yourself must also be involved.
Shipping to businesses (b2b)
Businesses such as restaurants, petrol stations, hospitals or administrations are treated like private final consumers, as so-called comparable sources of waste.
All packaging in which goods are packed or all packaging or packaging components that are added to the goods and that are sent to such a company must also be licensed.
Shipping from abroad to Germany (b2c)
If you export packaged goods from abroad to private end consumers in Germany, you are obliged to participate in a collection, recovery and recycling system for this packaging, including the shipping packaging.
Here, again, you are legally responsible for these goods when they cross the border.
